Terms of Service

1. Acceptance of terms

By creating an account or using Us (“the Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service. These terms are governed by the laws of England and Wales.

2. The Service

Us is a private shared space for couples to store memories, journal entries, recipes, wishlists, and plans. Each account is linked to exactly one partner account. The Service is provided by Daniel Atherton (“we”, “us”), based in the United Kingdom.

3. Accounts

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • Each account is for one individual and one partner. You may not share your account with anyone other than your designated partner.
  • You must provide accurate information when signing up. Accounts created with false information may be suspended.

4. Your content

You retain full ownership of all content you create or upload to the Service (“User Content”), including photos, journal entries, recipes, and memories.

By uploading User Content, you grant us a limited, non-exclusive licence to store and display it solely for the purpose of providing the Service to you and your partner. We do not claim ownership of your content and will not use it for any other purpose.

You are responsible for ensuring that any content you upload does not infringe the rights of third parties and complies with applicable law.

5. Acceptable use

You agree not to use the Service to:

  • Upload or share illegal content, including content that infringes copyright or contains CSAM.
  • Attempt to gain unauthorised access to another user's account or the Service's infrastructure.
  • Use the Service in any way that could damage, overload, or impair it.
  • Reverse-engineer, scrape, or copy any part of the Service without our written permission.
  • Use the Service for any commercial purpose without prior written consent.

6. Service availability

We aim to keep the Service available but do not guarantee uninterrupted access. We may suspend or modify the Service at any time for maintenance, security, or operational reasons. We will endeavour to give reasonable notice of planned downtime where possible.

7. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Service, including loss of data. Our total liability to you for any claim arising from these terms shall not exceed the amount you have paid us in the 12 months preceding the claim (which, for a free service, is £0).

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

8. Account termination

You may delete your account at any time from the Settings page. We may suspend or terminate your account if you breach these terms. On termination, your data will be deleted in accordance with our Privacy Policy.

9. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by posting a notice within the Service at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.

10. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
